Need for Email Filtering in e-Discovery

Email has become the most important source of evidence in litigation, and is the primary reason for the rapid growth of e-Discovery.  Case outcomes increasingly turn on the contemporaneous statements and admissions that are so often expressed and recorded in email.  The new e-discovery rule amendments to the Federal Rules of Civil Procedure and similar state rules make e-Discovery of email increasingly common in federal and state cases.  Plus attorneys are increasingly requesting and judges and magistrates are increasingly allowing discovery requests to require production of email in native file format.

But email discovery can be particularly difficult to prepare for production and analysis, as emails are usually found natively in compound Outlook PST and OST files that hold email, attachments and metadata, or in various other email formats such as Outlook Express DBX, or the individual email formats MSG and EML.  With these files it can be difficult to search, analyze and separate the potentially relevant email from the non-responsive.

Plus, relevant emails that must be produced are often mixed in with non-relevant business and personal emails, as well as privileged communications.  For these reasons, producing an entire Outlook PST or OST file, or an Outlook Express DBX directory to an adversary usually is not a good option.  Finding the relevant emails oneself is time consuming and error-prone.

Getting Started

It's easy to get started. Here are the steps we'll take to process your email collections and return only potentially responsive email.

Send us PST or OST files, or DBX, EML or MSG email collections. You send us entire PST and OST files, or individual collections of DBX, EML or MSG files, that you wish for us to process.  You can FedEx CDs, DVDs or portable drives to us.  Or upload the files directly to our secure FTP server for quicker service.  

Filtering by To, From, Date and/or Keyword.  We take 'to' and 'from' date ranges and keywords you supply, to filter out all email that do not meet your specified criteria. 

Deduplicate Email.  We identify and remove duplicate email from the potentially responsive data set, based on a comparison of key fields in the email metadata . 

We Send You Back the Responsive Emails.  After filtering, we send you back only the potentially responsive emails for your review.  You have several options as to how we return the potentially responsive emails.  We can provide these emails individually in MSG or EML format or as a new PST file composed only of the responsive email .  Or you can review the potentially responsive emails online in our Lexbe Online document repository (see next paragraph).

Online Review and Search Capability.  We include, at your option and without further charge, upload of responsive emails to our fully-featured review litigation review and analysis application, Lexbe Online.  If you have an existing case already set up on Lexbe Online, we can add the potentially responsive emails to your case.  If you are not an existing client, we provide free access for email review for thirty days.  (Lexbe Online pricing thereafter starts at just $79/m).  Lexbe Online allows you to further search and tag emails, construct dynamic timelines to organize facts, print or locally save individual emails and attachments, and much more.

Certificate of Completion.  At job completion, we will provide you on request with a certificate of the actions we have taken in processing your email stores.  This can be useful in showing that you have taken actions in good faith as required by applicable e-Discovery rules.
